Privacy
We are very pleased
about your interest in our company. Data protection is of a particularly high
priority for the management of Gebrüder Nippes GmbH & Co. KG. The use of
the websites of Gebrüder Nippes GmbH & Co. KG is generally possible without
providing any personal data. However, if a data subject wishes to make use of
special services of our company via our website, the processing of personal
data may become necessary. If the processing of personal data is necessary and
there is no legal basis for such processing, we generally obtain the consent of
the data subject.
The processing of personal data, such as the name, address, email address, or
telephone number of a data subject, is always carried out in accordance with
the General Data Protection Regulation and in compliance with the
country-specific data protection provisions applicable to Gebrüder Nippes GmbH
& Co. KG. By means of this privacy policy, our company would like to inform
the public about the nature, scope, and purpose of the personal data we
collect, use, and process. Furthermore, data subjects are informed of the
rights to which they are entitled by means of this privacy policy.
As the controller, Gebrüder Nippes GmbH & Co. KG has implemented numerous
technical and organizational measures to ensure the most complete protection
possible of the personal data processed via this website. Nevertheless,
internet-based data transmissions can in principle have security gaps, so that
absolute protection cannot be guaranteed. For this reason, every data subject
is free to transmit personal data to us by alternative means, for example by
telephone.
## 1. Definitions
The privacy policy of Gebrüder Nippes GmbH & Co. KG is based on the terms
used by the European legislator for the adoption of the General Data Protection
Regulation (GDPR). Our privacy policy should be legible and understandable for
the general public, as well as for our customers and business partners. To
ensure this, we would like to first explain the terminology used.
In this privacy policy, we use, among others, the following terms:
a) Personal data
Personal data means any information relating to an identified or identifiable
natural person (hereinafter "data subject"). An identifiable natural
person is one who can be identified, directly or indirectly, in particular by
reference to an identifier such as a name, an identification number, location
data, an online identifier, or to one or more factors specific to the physical,
physiological, genetic, mental, economic, cultural, or social identity of that
natural person.
b) Data subject
A data subject is any identified or identifiable natural person whose personal
data is processed by the controller responsible for the processing.
c) Processing
Processing is any operation or set of operations which is performed on personal
data or on sets of personal data, whether or not by automated means, such as
collection, recording, organization, structuring, storage, adaptation or
alteration, retrieval, consultation, use, disclosure by transmission,
dissemination or otherwise making available, alignment or combination,
restriction, erasure, or destruction.
d) Restriction of processing
Restriction of processing is the marking of stored personal data with the aim
of limiting their processing in the future.
e) Profiling
Profiling is any form of automated processing of personal data consisting of
the use of personal data to evaluate certain personal aspects relating to a
natural person, in particular to analyze or predict aspects concerning that
natural person's performance at work, economic situation, health, personal
preferences, interests, reliability, behavior, location, or movements.
f) Pseudonymization
Pseudonymization is the processing of personal data in such a manner that the
personal data can no longer be attributed to a specific data subject without
the use of additional information, provided that such additional information is
kept separately and is subject to technical and organizational measures that
ensure that the personal data is not attributed to an identified or
identifiable natural person.
g) Controller or controller
responsible for the processing
The controller or controller responsible for the processing is the natural or
legal person, public authority, agency, or other body which, alone or jointly
with others, determines the purposes and means of the processing of personal
data. Where the purposes and means of such processing are determined by Union
law or the law of the Member States, the controller or the specific criteria
for its nomination may be provided for by Union law or the law of the Member
States.
h) Processor
A processor is a natural or legal person, public authority, agency, or other
body which processes personal data on behalf of the controller.
i) Recipient
A recipient is a natural or legal person, public authority, agency, or other
body to which the personal data is disclosed, whether a third party or not.
However, public authorities which may receive personal data in the framework of
a particular inquiry in accordance with Union law or the law of the Member
States are not regarded as recipients.
j) Third party
A third party is a natural or legal person, public authority, agency, or body
other than the data subject, controller, processor, and the persons who, under
the direct authority of the controller or processor, are authorized to process
the personal data.
k) Consent
Consent is any freely given, specific, informed, and unambiguous indication of
the data subject's wishes by which the data subject, by a statement or by a
clear affirmative action, signifies agreement to the processing of personal
data relating to him or her.
## 2. Name and address of the controller
The controller for the purposes of the General Data Protection Regulation,
other data protection laws applicable in the Member States of the European
Union, and other provisions related to data protection is:
Gebrüder
Nippes GmbH & Co. KG
Straußplatz 2
42697 Solingen
Germany
Tel.: +49 (0)2 12 203 040
Email: info@nippes-solingen.de
Website: www.shop.nippes-solingen.de
## 3. Name and address of the Data
Protection Officer
For questions regarding the collection, processing, or use of your personal
data, for information, correction, restriction, or erasure of data, as well as
the revocation of consent given or objection to a particular use of data,
please contact us directly using the contact details provided in our legal
notice (Impressum).
## 4. Cookies
The websites of Gebrüder Nippes GmbH & Co. KG use cookies. Cookies are text
files that are placed and stored on a computer system via an internet
browser.
Numerous websites and servers use cookies. Many cookies contain a so-called
cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a
character string through which websites and servers can be assigned to the
specific internet browser in which the cookie was stored. This enables the
visited websites and servers to distinguish the individual browser of the data
subject from other internet browsers that contain other cookies. A specific
internet browser can be recognized and identified via the unique cookie ID.
Through the use of cookies, Gebrüder Nippes GmbH & Co. KG can provide the
users of this website with more user-friendly services that would not be
possible without the setting of cookies.
By means of a cookie, the information and offers on our website can be
optimized in the interest of the user. As already mentioned, cookies enable us
to recognize the users of our website. The purpose of this recognition is to
make it easier for users to use our website. For example, the user of a website
that uses cookies does not have to re-enter their access data each time they
visit the website, because this is handled by the website and the cookie stored
on the user's computer system. Another example is the cookie of a shopping cart
in the online shop. The online shop remembers the items that a customer has
placed in the virtual shopping cart via a cookie.
The data subject can prevent the setting of cookies by our website at any time
by means of a corresponding setting of the internet browser used and can thus
permanently object to the setting of cookies. Furthermore, cookies that have
already been set can be deleted at any time via an internet browser or other
software programs. This is possible in all common internet browsers. If the
data subject deactivates the setting of cookies in the internet browser used,
not all functions of our website may be fully usable.
## 5. Collection of general data and information
With each access to the website by a data subject or an automated system, the
website of Gebrüder Nippes GmbH & Co. KG collects a series of general data
and information. This general data and information is stored in the server's
log files. The following may be collected: (1) the browser types and versions
used, (2) the operating system used by the accessing system, (3) the website
from which an accessing system reaches our website (so-called referrer), (4)
the sub-pages accessed via an accessing system on our website, (5) the date and
time of access to the website, (6) an internet protocol address (IP address),
(7) the internet service provider of the accessing system, and (8) other
similar data and information that serve to avert danger in the event of attacks
on our information technology systems.
When using this general data and information, Gebrüder Nippes GmbH & Co. KG
does not draw any conclusions about the data subject. Rather, this information
is needed to (1) deliver the content of our website correctly, (2) optimize the
content of our website as well as the advertising for it, (3) ensure the
long-term functionality of our information technology systems and the
technology of our website, and (4) provide law enforcement authorities with the
information necessary for prosecution in the event of a cyberattack. Therefore,
this anonymously collected data and information is evaluated by Gebrüder Nippes
GmbH & Co. KG both statistically and with the aim of increasing data
protection and data security in our company, in order to ultimately ensure an optimal
level of protection for the personal data we process. The anonymous data of the
server log files is stored separately from all personal data provided by a data
subject.
## 6. Registration on our website
The data subject has the option to register on the controller's website by
providing personal data. Which personal data is transmitted to the controller
in the process results from the respective input mask used for the
registration. The personal data entered by the data subject is collected and
stored exclusively for internal use by the controller and for its own purposes.
The controller may arrange for the data to be transferred to one or more
processors, for example a parcel service provider, who also uses the personal
data exclusively for internal use attributable to the controller.
By registering on the controller's website, the IP address assigned by the data
subject's internet service provider (ISP), as well as the date and time of
registration, are also stored. The storage of this data takes place against the
background that this is the only way to prevent the misuse of our services, and
this data, if necessary, enables criminal offenses that have been committed to
be investigated. In this respect, the storage of this data is necessary to secure
the controller. This data is generally not passed on to third parties, unless
there is a legal obligation to pass it on or the disclosure serves the purpose
of criminal prosecution.
The registration of the data subject with the voluntary provision of personal
data serves the controller in offering the data subject content or services
that, by their nature, can only be offered to registered users. Registered
persons are free to change the personal data provided during registration at
any time, or to have it completely deleted from the controller's data set.
The controller provides each data subject, at any time upon request, with
information about which personal data is stored about the data subject.
Furthermore, the controller corrects or erases personal data at the request or
instruction of the data subject, provided that no statutory retention
obligations preclude this. All employees of the controller are available to the
data subject as contact persons in this regard.
## 7. Subscription to our newsletter
On the website of Gebrüder Nippes GmbH & Co. KG, users are given the
opportunity to subscribe to our company's newsletter. Which personal data is
transmitted to the controller when ordering the newsletter results from the
input mask used for this purpose.
Gebrüder Nippes GmbH & Co. KG informs its customers and business partners
at regular intervals by way of a newsletter about offers of the company. Our
company's newsletter can generally only be received by the data subject if (1)
the data subject has a valid email address and (2) the data subject registers
for the newsletter dispatch. For legal reasons, a confirmation email is sent to
the email address first registered by a data subject for the newsletter
dispatch, using the double opt-in procedure. This confirmation email serves to
verify whether the owner of the email address, as the data subject, has
authorized the receipt of the newsletter.
When registering for the newsletter, we also store the IP address assigned by
the internet service provider (ISP) of the computer system used by the data
subject at the time of registration, as well as the date and time of
registration. The collection of this data is necessary in order to be able to
trace the (possible) misuse of a data subject's email address at a later point
in time, and therefore serves the legal protection of the controller.
The personal data collected as part of a newsletter registration is used
exclusively to send our newsletter. Furthermore, newsletter subscribers may be
informed by email if this is necessary for the operation of the newsletter
service or a related registration, as could be the case in the event of changes
to the newsletter offer or changes in technical circumstances. The personal
data collected as part of the newsletter service is not passed on to third
parties. The subscription to our newsletter can be terminated by the data
subject at any time. The consent to the storage of personal data that the data
subject has given us for the newsletter dispatch can be revoked at any time.
For the purpose of revoking consent, a corresponding link can be found in every
newsletter. It is also possible to unsubscribe from the newsletter dispatch at
any time directly on the controller's website, or to notify the controller of
this in another way.
## 8. Newsletter tracking
The newsletters of Gebrüder Nippes GmbH & Co. KG contain so-called tracking
pixels. A tracking pixel is a miniature graphic embedded in such emails that
are sent in HTML format, in order to enable log file recording and log file
analysis. This makes it possible to carry out a statistical evaluation of the
success or failure of online marketing campaigns. Based on the embedded
tracking pixel, Gebrüder Nippes GmbH & Co. KG can recognize whether and
when an email was opened by a data subject, and which links contained in the
email were accessed by the data subject.
Such personal data collected via the tracking pixels contained in the
newsletters is stored and evaluated by the controller in order to optimize the
newsletter dispatch and to adapt the content of future newsletters even better
to the interests of the data subject. This personal data is not passed on to
third parties. Data subjects are entitled at any time to revoke the separate
declaration of consent given via the double opt-in procedure. After a
revocation, this personal data is deleted by the controller. Gebrüder Nippes
GmbH & Co. KG automatically interprets an unsubscription from the receipt
of the newsletter as a revocation.
## 9. Contact option via the website
Due to legal regulations, the website of Gebrüder Nippes GmbH & Co. KG
contains information that enables quick electronic contact with our company as
well as direct communication with us, which also includes a general address for
so-called electronic mail (email address). If a data subject contacts the
controller by email or via a contact form, the personal data transmitted by the
data subject is automatically stored. Such personal data transmitted on a
voluntary basis by a data subject to the controller is stored for the purposes
of processing or contacting the data subject. This personal data is not passed
on to third parties.
## 10. Routine erasure and blocking of personal data
The controller processes and stores the personal data of the data subject only
for the period necessary to achieve the purpose of storage, or insofar as this
is provided for by the European legislator or another legislator in laws or
regulations to which the controller is subject.
If the purpose of storage no longer applies, or if a storage period prescribed
by the European legislator or another competent legislator expires, the
personal data is routinely blocked or erased in accordance with the legal
provisions.
## 11. Rights of the data subject
a) Right to confirmation
Every data subject has the right, granted by the European legislator, to obtain
from the controller confirmation as to whether or not personal data concerning
him or her is being processed. If a data subject wishes to exercise this right
of confirmation, he or she can contact an employee of the controller at any
time.
b) Right to information (access)
Every data subject affected by the processing of personal data has the right,
granted by the European legislator, to obtain from the controller free information
about the personal data stored about him or her, and a copy of this
information, at any time. Furthermore, the European legislator has granted the
data subject access to the following information:
the purposes of the processing
the categories of personal data being processed
the recipients or categories of recipients to whom the personal data has been
or will be disclosed, in particular recipients in third countries or
international organizations
where possible, the envisaged period for which the personal data will be
stored, or, if this is not possible, the criteria used to determine that
period
the existence of the right to request from the controller rectification or
erasure of the personal data concerning him or her, or restriction of
processing, or a right to object to such processing
the existence of the right to lodge a complaint with a supervisory authority
where the personal data is not collected from the data subject: any available
information as to the source of the data
the existence of automated decision-making, including profiling, referred to in
Article 22(1) and (4) GDPR and — at least in those cases — meaningful
information about the logic involved, as well as the significance and the
envisaged consequences of such processing for the data subject
Furthermore, the data subject has a right to information as to whether personal
data has been transferred to a third country or to an international
organization. If this is the case, the data subject also has the right to
obtain information about the appropriate safeguards relating to the
transfer.
If a data subject wishes to exercise this right of access, he or she can
contact an employee of the controller at any time.
c) Right to rectification
Every data subject affected by the processing of personal data has the right,
granted by the European legislator, to obtain the rectification without undue
delay of inaccurate personal data concerning him or her. Furthermore, the data
subject has the right, taking into account the purposes of the processing, to
have incomplete personal data completed — including by means of providing a
supplementary statement.
If a data subject wishes to exercise this right to rectification, he or she can
contact an employee of the controller at any time.
d) Right to erasure (right to be
forgotten)
Every data subject affected by the processing of personal data has the right,
granted by the European legislator, to obtain from the controller the erasure
without undue delay of personal data concerning him or her, where one of the
following grounds applies and insofar as the processing is not necessary:
The personal data was collected or otherwise processed for purposes for which
it is no longer necessary.
The data subject withdraws consent on which the processing was based pursuant
to Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, and there is no other legal ground
for the processing.
The data subject objects to the processing pursuant to Art. 21(1) GDPR and
there are no overriding legitimate grounds for the processing, or the data
subject objects to the processing pursuant to Art. 21(2) GDPR.
The personal data was unlawfully processed.
The erasure of the personal data is necessary for compliance with a legal
obligation under Union or Member State law to which the controller is
subject.
The personal data was collected in relation to the offer of information society
services pursuant to Art. 8(1) GDPR.
If one of the above-mentioned grounds applies and a data subject wishes to
arrange for the erasure of personal data stored by Gebrüder Nippes GmbH &
Co. KG, he or she can contact an employee of the controller at any time. The
employee of Gebrüder Nippes GmbH & Co. KG will arrange for the erasure
request to be complied with without undue delay.
If the personal data has been made public by Gebrüder Nippes GmbH & Co. KG
and our company, as the controller, is obliged pursuant to Art. 17(1) GDPR to
erase the personal data, Gebrüder Nippes GmbH & Co. KG, taking into account
the available technology and the cost of implementation, will take reasonable
measures, including of a technical nature, to inform other controllers
processing the published personal data that the data subject has requested the
erasure by these other controllers of any links to, or copies or replications
of, this personal data, insofar as the processing is not necessary. The
employee of Gebrüder Nippes GmbH & Co. KG will arrange what is necessary in
each individual case.
e) Right to restriction of
processing
Every data subject affected by the processing of personal data has the right,
granted by the European legislator, to obtain from the controller restriction
of processing where one of the following applies:
The accuracy of the personal data is contested by the data subject, for a
period enabling the controller to verify the accuracy of the personal data.
The processing is unlawful, the data subject opposes the erasure of the
personal data, and requests instead the restriction of the use of the personal
data.
The controller no longer needs the personal data for the purposes of the
processing, but the data subject requires it for the establishment, exercise,
or defense of legal claims.
The data subject has objected to the processing pursuant to Art. 21(1) GDPR and
it has not yet been determined whether the legitimate grounds of the controller
override those of the data subject.
If one of the above-mentioned conditions is met and a data subject wishes to
request the restriction of personal data stored by Gebrüder Nippes GmbH &
Co. KG, he or she can contact an employee of the controller at any time. The
employee of Gebrüder Nippes GmbH & Co. KG will arrange for the restriction
of the processing.
f) Right to data portability
Every data subject affected by the processing of personal data has the right,
granted by the European legislator, to receive the personal data concerning him
or her, which was provided to a controller by the data subject, in a
structured, commonly used, and machine-readable format. He or she also has the
right to transmit this data to another controller without hindrance from the
controller to which the personal data was provided, provided that the
processing is based on consent pursuant to Art. 6(1)(a) GDPR or Art. 9(2)(a)
GDPR, or on a contract pursuant to Art. 6(1)(b) GDPR, and that the processing
is carried out by automated means, provided that the processing is not
necessary for the performance of a task carried out in the public interest or
in the exercise of official authority vested in the controller.
Furthermore, in exercising the right to data portability pursuant to Art. 20(1)
GDPR, the data subject has the right to have the personal data transmitted
directly from one controller to another, where technically feasible and
provided that this does not adversely affect the rights and freedoms of
others.
To assert the right to data portability, the data subject can contact an
employee of Gebrüder Nippes GmbH & Co. KG at any time.
g) Right to object
Every data subject affected by the processing of personal data has the right,
granted by the European legislator, to object, on grounds relating to his or
her particular situation, at any time to the processing of personal data
concerning him or her which is based on Art. 6(1)(e) or (f) GDPR. This also
applies to profiling based on these provisions.
In the event of an objection, Gebrüder Nippes GmbH & Co. KG will no longer
process the personal data, unless we can demonstrate compelling legitimate
grounds for the processing which override the interests, rights, and freedoms
of the data subject, or the processing serves the establishment, exercise, or
defense of legal claims.
If Gebrüder Nippes GmbH & Co. KG processes personal data in order to carry
out direct marketing, the data subject has the right to object at any time to
the processing of personal data for the purpose of such marketing. This also
applies to profiling insofar as it is connected with such direct marketing. If
the data subject objects to Gebrüder Nippes GmbH & Co. KG against
processing for direct marketing purposes, Gebrüder Nippes GmbH & Co. KG
will no longer process the personal data for these purposes.
In addition, the data subject has the right, on grounds relating to his or her
particular situation, to object to the processing of personal data concerning
him or her which is carried out by Gebrüder Nippes GmbH & Co. KG for
scientific or historical research purposes, or for statistical purposes
pursuant to Art. 89(1) GDPR, unless such processing is necessary for the
performance of a task carried out in the public interest.
To exercise the right to object, the data subject can directly contact any
employee of Gebrüder Nippes GmbH & Co. KG or another employee. The data
subject is also free, in the context of the use of information society
services, and notwithstanding Directive 2002/58/EC, to exercise his or her
right to object by automated means using technical specifications.
h) Automated individual
decision-making, including profiling
Every data subject affected by the processing of personal data has the right,
granted by the European legislator, not to be subject to a decision based
solely on automated processing — including profiling — which produces legal
effects concerning him or her or similarly significantly affects him or her,
provided that the decision (1) is not necessary for entering into, or the
performance of, a contract between the data subject and the controller, or (2)
is authorized by Union or Member State law to which the controller is subject
and which lays down suitable measures to safeguard the data subject's rights
and freedoms and legitimate interests, or (3) is based on the data subject's
explicit consent.
If the decision (1) is necessary for entering into, or the performance of, a
contract between the data subject and the controller, or (2) is based on the
data subject's explicit consent, Gebrüder Nippes GmbH & Co. KG takes
suitable measures to safeguard the data subject's rights and freedoms and
legitimate interests, which include at least the right to obtain human
intervention on the part of the controller, to express his or her point of
view, and to contest the decision.
If the data subject wishes to assert rights relating to automated
decision-making, he or she can contact an employee of the controller at any
time.
i) Right to withdraw consent under
data protection law
Every data subject affected by the processing of personal data has the right,
granted by the European legislator, to withdraw consent to the processing of
personal data at any time.
If the data subject wishes to exercise the right to withdraw consent, he or she
can contact an employee of the controller at any time.
## 12. Data protection in applications and the application procedure
The controller collects and processes the personal data of applicants for the
purpose of handling the application procedure. The processing may also take
place by electronic means. This is particularly the case if an applicant
submits the relevant application documents to the controller by electronic
means, for example by email or via a web form on the website. If the controller
concludes an employment contract with an applicant, the transmitted data is
stored for the purpose of handling the employment relationship in compliance
with the legal provisions. If no employment contract is concluded by the
controller with the applicant, the application documents are automatically
deleted two months after notification of the rejection decision, provided that
no other legitimate interests of the controller preclude such deletion. Another
legitimate interest in this sense is, for example, a burden of proof in
proceedings under the General Equal Treatment Act (AGG).
## 13. Data protection provisions on the use of Facebook
The controller has integrated components of the company Facebook on this
website. Facebook is a social network.
A social network is an online social meeting place, an online community that
generally enables users to communicate with one another and interact in a
virtual space. A social network can serve as a platform for the exchange of
opinions and experiences, or enable the internet community to provide personal
or company-related information. Facebook enables users of the social network,
among other things, to create private profiles, upload photos, and connect via
friend requests.
The operating company of Facebook is Facebook, Inc., 1 Hacker Way, Menlo Park,
CA 94025, USA. If a data subject lives outside the USA or Canada, the
controller for the processing of personal data is Facebook Ireland Ltd., 4
Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
With each access to one of the individual pages of this website operated by the
controller, on which a Facebook component (Facebook plug-in) has been
integrated, the internet browser on the information technology system of the
data subject is automatically prompted by the respective Facebook component to
download a representation of the corresponding Facebook component from
Facebook. An overview of all Facebook plug-ins can be accessed at
https://developers.facebook.com/docs/plugins/?locale=de_DE. In the course of
this technical procedure, Facebook obtains knowledge of which specific sub-page
of our website is visited by the data subject.
If the data subject is logged into Facebook at the same time, Facebook
recognizes, with each access to our website by the data subject and for the
entire duration of the respective stay on our website, which specific sub-page
of our website the data subject visits. This information is collected by the
Facebook component and assigned by Facebook to the respective Facebook account
of the data subject. If the data subject clicks one of the Facebook buttons
integrated on our website, for example the "Like" button, or if the
data subject submits a comment, Facebook assigns this information to the personal
Facebook user account of the data subject and stores this personal data.
Facebook always receives information via the Facebook component that the data
subject has visited our website, whenever the data subject is logged into
Facebook at the time of accessing our website; this takes place regardless of
whether the data subject clicks the Facebook component or not. If such a
transmission of this information to Facebook is not desired by the data
subject, he or she can prevent the transmission by logging out of his or her
Facebook account before accessing our website.
The data policy published by Facebook, which is available at
https://de-de.facebook.com/about/privacy/, provides information about the
collection, processing, and use of personal data by Facebook. It also explains
which setting options Facebook offers to protect the privacy of the data
subject. In addition, various applications are available that make it possible
to suppress data transmission to Facebook. Such applications can be used by the
data subject to suppress data transmission to Facebook.
## 14. Data protection provisions on the use of functions of the Amazon
affiliate program
As a participant in the Amazon affiliate program, the controller has integrated
Amazon components on this website. The Amazon components were designed by
Amazon with the aim of referring customers, via advertisements, to various
websites of the Amazon group, in particular to Amazon.co.uk,
Local.Amazon.co.uk, Amazon.de, BuyVIP.com, Amazon.fr, Amazon.it, and Amazon.es,
BuyVIP.com, in return for payment of a commission. By using the Amazon
components, the controller can generate advertising revenue.
The operating company of these Amazon components is Amazon EU S.à.r.l, 5 Rue
Plaetis, L-2338 Luxembourg, Luxembourg.
Amazon sets a cookie on the information technology system of the data subject.
What cookies are has already been explained above. With each individual access
to one of the individual pages of this website operated by the controller, on
which an Amazon component has been integrated, the internet browser on the
information technology system of the data subject is automatically prompted by
the respective Amazon component to transmit data to Amazon for the purpose of
online advertising and the settlement of commissions. In the course of this
technical procedure, Amazon obtains knowledge of personal data that serves
Amazon in tracing the origin of orders received by Amazon and subsequently
enabling a commission settlement. Amazon can, among other things, trace that the
data subject has clicked an affiliate link on our website.
As already described above, the data subject can prevent the setting of cookies
by our website at any time by means of a corresponding setting of the internet
browser used, and thus permanently object to the setting of cookies. Such a
setting of the internet browser used would also prevent Amazon from setting a
cookie on the information technology system of the data subject. In addition,
cookies already set by Amazon can be deleted at any time via an internet
browser or other software programs.
Further information and the applicable data protection provisions of Amazon can
be accessed at
https://www.amazon.de/gp/help/customer/display.html?nodeId=3312401.
## 15. Data protection provisions on the use of Instagram
The controller has integrated components of the Instagram service on this
website. Instagram is a service that qualifies as an audiovisual platform and
enables users to share photos and videos, as well as to further disseminate
such data on other social networks.
The operating company of the Instagram services is Instagram LLC, 1 Hacker Way,
Building 14 First Floor, Menlo Park, CA, USA.
With each access to one of the individual pages of this website operated by the
controller, on which an Instagram component (Insta button) has been integrated,
the internet browser on the information technology system of the data subject
is automatically prompted by the respective Instagram component to download a
representation of the corresponding component from Instagram. In the course of
this technical procedure, Instagram obtains knowledge of which specific
sub-page of our website is visited by the data subject.
If the data subject is logged into Instagram at the same time, Instagram
recognizes, with each access to our website by the data subject and for the
entire duration of the respective stay on our website, which specific sub-page
the data subject visits. This information is collected by the Instagram
component and assigned by Instagram to the respective Instagram account of the
data subject. If the data subject clicks one of the Instagram buttons
integrated on our website, the data and information transmitted thereby is
assigned to the personal Instagram user account of the data subject and stored and
processed by Instagram.
Instagram always receives information via the Instagram component that the data
subject has visited our website, whenever the data subject is logged into
Instagram at the time of accessing our website; this takes place regardless of
whether the data subject clicks the Instagram component or not. If such a
transmission of this information to Instagram is not desired by the data
subject, he or she can prevent the transmission by logging out of his or her
Instagram account before accessing our website.

## 16. Payment method: Data protection provisions on PayPal as a payment
method
The controller has integrated components of PayPal on this website. PayPal is
an online payment service provider. Payments are processed via so-called PayPal
accounts, which represent virtual private or business accounts. In addition,
PayPal offers the possibility of processing virtual payments via credit cards
if a user does not maintain a PayPal account. A PayPal account is managed via
an email address, which is why there is no classic account number. PayPal makes
it possible to initiate online payments to third parties or to receive
payments. PayPal also assumes trustee functions and offers buyer protection
services.
The European operating company of PayPal is PayPal (Europe) S.à.r.l. & Cie.
S.C.A., 22-24 Boulevard Royal, 2449 Luxembourg, Luxembourg.
If the data subject selects "PayPal" as a payment option during the
ordering process in our online shop, data of the data subject is automatically
transmitted to PayPal. By selecting this payment option, the data subject
consents to the transmission of personal data required for payment
processing.
The personal data transmitted to PayPal is generally first name, last name,
address, email address, IP address, telephone number, mobile telephone number,
or other data necessary for payment processing. Personal data related to the
respective order is also necessary for processing the purchase contract.
The transmission of the data is intended for payment processing and fraud
prevention. The controller will transmit personal data to PayPal in particular
if there is a legitimate interest in the transmission. The personal data
exchanged between PayPal and the controller may be transmitted by PayPal to
credit reference agencies. This transmission is intended for identity and creditworthiness
checks.
PayPal may pass on the personal data to affiliated companies and service
providers or subcontractors, insofar as this is necessary to fulfill the
contractual obligations or the data is to be processed on its behalf.
The data subject has the option to revoke consent to the handling of personal
data at any time vis-à-vis PayPal. A revocation does not affect personal data
that must be processed, used, or transmitted for (contractual) payment
processing.
The applicable data protection provisions of PayPal can be accessed at
https://www.paypal.com/de/webapps/mpp/ua/privacy-full.
## 17. Legal basis for the processing
Art. 6(1)(a) GDPR serves our company as the legal basis for processing
operations for which we obtain consent for a specific processing purpose. If
the processing of personal data is necessary for the performance of a contract
to which the data subject is a party, as is the case, for example, with
processing operations necessary for the supply of goods or the provision of any
other service or consideration, the processing is based on Art. 6(1)(b) GDPR.
The same applies to such processing operations as are necessary for carrying
out pre-contractual measures, for example in the case of inquiries about our
products or services. If our company is subject to a legal obligation requiring
the processing of personal data, such as for the fulfillment of tax
obligations, the processing is based on Art. 6(1)(c) GDPR. In rare cases, the
processing of personal data may become necessary to protect the vital interests
of the data subject or of another natural person. This would be the case, for
example, if a visitor were to be injured on our premises and, as a result,
their name, age, health insurance data, or other vital information had to be
passed on to a doctor, hospital, or other third party. The processing would
then be based on Art. 6(1)(d) GDPR. Finally, processing operations could be
based on Art. 6(1)(f) GDPR. Processing operations that are not covered by any
of the aforementioned legal bases are based on this legal basis if the
processing is necessary to safeguard a legitimate interest of our company or a
third party, provided that the interests, fundamental rights, and freedoms of
the data subject do not override it. Such processing operations are permitted
to us in particular because they have been specifically mentioned by the
European legislator. In this respect, the legislator took the view that a
legitimate interest could be assumed if the data subject is a customer of the controller
(Recital 47, sentence 2 GDPR).
## 18. Legitimate interests in the processing pursued by the controller or a
third party
Where the processing of personal data is based on Article 6(1)(f) GDPR, our
legitimate interest is the conduct of our business activities for the benefit
of the well-being of all our employees and our shareholders.
## 19. Period for which the personal data is stored
The criterion for the duration of the storage of personal data is the
respective statutory retention period. After the expiry of the period, the
corresponding data is routinely deleted, provided that it is no longer
necessary for the performance or initiation of the contract.
## 20. Statutory or contractual requirements to provide the personal data;
necessity for the conclusion of the contract; obligation of the data subject to
provide the personal data; possible consequences of failure to provide such
data
We inform you that the provision of personal data is partly required by law
(e.g. tax regulations) or may also result from contractual provisions (e.g.
information about the contractual partner). Sometimes, in order to conclude a
contract, it may be necessary for a data subject to provide us with personal
data that must subsequently be processed by us. The data subject is, for
example, obliged to provide us with personal data if our company concludes a
contract with him or her. Failure to provide the personal data would result in
the contract with the data subject not being able to be concluded. Before
personal data is provided by the data subject, the data subject must contact
one of our employees. Our employee will explain to the data subject, on a
case-by-case basis, whether the provision of the personal data is required by
law or by contract or is necessary for the conclusion of the contract, whether
there is an obligation to provide the personal data, and what the consequences
of failure to provide the personal data would be.
## 21. Existence of automated decision-making
As a responsible company, we refrain from automated decision-making or
profiling.
